New Image will not assume any liability whatsoever, and shall be held harmless against any liability or any injuries, losses or damages of any kind to persons, including illness, death, or property resulting in whole or part, directly or indirectly, from acceptance, possession, misuse, use or participation of this program. Void where prohibited.

New Image assumes no responsibility for computer systems, hardware, software or program malfunctions or for other errors, failures, or delays in computer transmissions or network connections that are human or technical in nature or for lost, late, mutilated, illegible, postage-due, incomplete or misdirected information.

The New Image Program is available only to individuals eighteen years of age and older, and to individuals who can form legally binding contracts under applicable law. By using New Image, you represent and warrant that you meet these criteria and you agree to having the ability under applicable law to enter into a legally binding contract. Members must provide a valid email address.  New Image reserves the right to refuse membership for any reason, including certain medical conditions.

Member's may receive a refund by returning their personal "home success plan" within 30 days of their order date less a $10 non-refundable registration fee and shipping costs.  The "home plan" must be received within 30 days of the order date.  No refunds will be issued for any returns received more than 30 days after the order date.  A request to cancel a membership does not entitle any member to a refund.  New Image does not issue refunds for membership cancellations, late returns, non-use of program, technical problems, change of personal circumstances or change of heart.

Members are financially responsible for the total cost of their program and membership.  Any non-payment of a membership will result in additional fees, membership suspension, and the account being turned over to collections.

There are no monthly or additional fees after the initial payment of any membership.  Members are required to weigh in by submitting their weight using our online form at least once every six months to keep their membership active.  Any member who has not weighed in for six consecutive months will be declared inactive and their User ID and Password will be removed from our database.  Once a member is declared inactive there will be a small fee to renew the membership at the member's request.

Each membership is to be used by original member only.  It is not permissible to "share" or "transfer" any memberships.  We reserve the right to suspend any membership without refund due to abuse of that membership.  This includes but is not limited to sharing login information, improper treatment of other members or our staff, sharing membership privileges with non-members.

Any member that requests a chargeback, either by mistake or fraudulently will be assessed a $25 processing fee for each individual chargeback.  Any member that pays for their program with a check and that check is returned due to non-sufficient funds will be charged a $25 processing fee.

New Image reserves the right to make changes to the website, policies and member terms at any time, effective immediately upon the posting on this website.  Please check these terms periodically.
